Your case will usually be heard either by a single specialist employment judge sitting alone or by a panel of three experts consisting of an employment judge and two lay member from industry such as those from Human Resources or Trade Union backgrounds.
Where the parties consent a hearing that should have been considered by a panel of three (e.g. discrimination, detriment) may be considered by an employment judge and just one lay member. This may arise in unusual circumstances such as where one lay member becomes very ill mid-trial, dies or is suddenly unavailable.
It is appropriate to address the judge and lay members as Sir/Madam or Ma’am for short.
