3PB’s specialist property barristers have significant experience in advising and representing clients on a wide range of trusts of land issues, including express, resulting or constructive trusts, and extending to issues such as proprietary estoppel, misrepresentation and undue influence.

Our barristers regularly appear in court or provide their advice in relation to domestic and commercial. Typical work includes:

  • Advising on the validity and construction of trusts, sham arrangements and applications to set aside previous court orders
  • Applications relating to disclosure of documentation, legal costs protection and removal of trustees
  • Representation of clients in relation to claims under both Part 7 and Part 8 of the Civil Procedure Rules
  • Negotiation of settlements, including in mediation
  • Actions against trustees for breaches of trust and actions relating to accounting and tracing.

Some of 3PB’s barristers have wide-ranging experience across property law, family law and probate law and are therefore able to assist in crossover cases involving, for example disputes arising out of breakdown of cohabiting relationships, disputes between family members, or inheritance disputes.
