Legal Expertise

I accept instructions from both husbands and wives in all areas of divorce and family finance in marital or couple break-ups, including cases involving cohabitation, domestic abuse, and TOLATA claims. In recent family finance work I have:

  • Represented and advised husband throughout matrimonial finance, TOLATA and Children Act proceedings on a direct access basis, successfully proving contempt of court by fraudulent falsification of bank statements.
  • Settled a divorce claim achieving an 80/20 property split in favour of the wife.
  • Represented husband throughout proceedings for non-molestation orders, occupation orders, children arrangements, and divorce, successfully proving fraudulent falsification of bank statements and lying in court.
  • Represented at mediation and subsequently achieved outright lump sum for rehousing for the wife in joint TOLATA and Schedule 1 proceedings following an Islamic marriage, and drafted the settlement agreement and charge on a property.
  • Represented mother in children proceedings together with a joint TOLATA and Schedule 1 proceedings, successfully settling at FDR, and representation for enforcement and trial of children matters and dispute about contents of the home.

I undertake a wide range of work and have been instructed by mothers, fathers, grandparents and NYAS in applications for child arrangement orders, prohibited steps orders and specific issue orders. I will act for you at all stages of proceedings and frequently my cases involve sensitive elements such as intractable hostility, domestic and sexual abuse (including allegations of sexual abuse towards the child), mental health, drug and alcohol abuse, relocation, and witness protection.

As well as private disputes, I often represent clients in proceedings involving social services, both in the Family Court for children and in the Court of Protection for adults. I have worked on two secondments with local authorities advising on a large number of individual cases and understand Court of Protection casework and have frequently provided representation in the Court, with a particular emphasis on deprivation of liberty, and where capacity or lasting power of attorney issues are at stake.

Recent cases have included:

  • Negotiating the return of children in a father’s urgent application following the mother’s relocation by agreement involving the grant of a licence on a house for the mother, and drafting it at court.
  • Successfully obtaining no order for contact in a case where the father suffered from alcoholism and the children did not wish to see him.
  • Acting in inherent jurisdiction proceedings in relation to 15-year-old boy with behavioural difficulties.
  • Representing a father in an 8-day final care hearing, prepared following advice and grounds of appeal, and advised on revocation of placement order.
  • Successfully representing a mother in resisting an application by the father for contact where the 12-year-old child’s wishes and feelings were strongly against any direct contact exhibited through school non-attendance, self-harm and suicidal thoughts.
  • Representing a father in an application for a secure accommodation order and deprivation of liberty orders in relation to a 16-year-old girl.
  • Representing the grandmother of children at a directions hearing in the context of the children’s move into witness protection meaning she would be denied all contact.
  • Successfully representing a mother in her application for the discharge of a Special Guardianship Order.

I advise clients in property law disputes and regularly represent them at hearings and mediations, as well as drafting necessary documents for issuing and defending claims. I do work in most areas of property law including:

  • Applications under the Trusts of Land and Appointment of Trustees Act (TOLATA) 1996
  • Court of Protections property & affairs cases
  • Insurance Act claims and probate disputes
  • Boundary disputes and claims for trespass and nuisance
  • Disputes over covenants, easements and rights of way
  • Landlord and tenant disputes, including possession hearings and breaches of covenant and housing disrepair
  • Assured agricultural occupancies
  • Service charge disputes
  • Misrepresentation on house sale
  • Proceedings relating to social housing, mobile homes and licensed premises; and
  • Registration and title issues.
