My practice includes advising and representing clients in respect of the administration of an estate, large or small, whether under a will or an intestacy. I have extensive experience of representing executors/administrators (personal representatives) and also beneficiaries or “would be” beneficiaries of an estate. My work includes bringing and defending challenges to wills, advising in respect of of breach of duty claims brought against the executor/administrator, advising on how an estate should be administered and acting for and against claimants in Inheritance Act claims. I am also able to advise on aspects of non-contentious probate matters.
Some recent examples include defending a claim for revocation of the grant of letters of administration and for removal of the administrator of a £2.5 million estate, on the construction of a will in a farming family dispute and for a claimant cohabitee for reasonable financial provision to be made for her from the deceased’s £2 million estate, which she received nothing from under the rules of intestacy.
I also accept instructions to bring and defend claims as to the ownership of land arising, for example, from a breakdown in a relationship. As with my contentious wills/inheritance work, I can advise at the very early stages of any proposed litigation through to the trial itself and any mediation or settlement discussions along the way.
