A large focus of my practice is dispute resolution in the construction industry where I’ve handled two party and multi-party disputes with values up to £8 million.

How much experience do you have in this area?

I bring over 30 years’ experience in the construction industry and recently produced my own website www.aeberli.com which includes a number of papers on construction law, arbitration and adjudication.

If you hadn’t become a barrister what would you have done instead?

Prior to qualifying as a barrister, I was a project architect with the Building Design Partnership and gained experience and understanding of the different skills, both professional and contracting, needed to realise complex construction projects, including hospitals, retail development and military installations. I also have a good understanding of building technology from my time spent as a university lecturer at Oxford Brookes University. If I hadn’t become a barrister I think I’d have definitely have considered continuing my career as an architect.

Legal Expertise

My experience spans across the entire construction industry and I’ve been instructed on construction and arbitration related matters in the Technology and Court Court (TCC) and the County Courts. I’m also routinely called upon to draft contracts including amendments to JCT contracts (the Joint Contracts Tribunal (JCT) suite of contracts is a set of standard documents used by the building industry to help deliver a building project). In addition, I advise and represents parties in arbitration, adjudication and mediation proceedings.My overseas work includes advising parties in Latvia and in South Africa on contractual (FIDIC) and arbitration matters.

I’ve been appointed by party agreement and from numerous appointing bodies including the Chartered Institute of Arbitrators, the RIBA, the Law Society, the RICS, FIDIC and the ICC.

In terms of cases, I’ve been involved in a wide variety of disputes involving:

  • Legal issues.
  • Development and partnering agreements.
  • Technical issues, such as alleged paint, roofing, cladding, and structural defects.
  • Environmental (including nuclear) issues.
  • Professional negligence.
  • Delay and programming issues and disruption and delay costs.
  • Interim and final account valuation.
  • Commercial agency agreements.
  • International disputes, including ICC arbitration and FIDIC dispute board work.

I’ve also mediated numerous construction and professional negligence disputes as well as disputes outside the construction sector, including in regard to wills, landlord and tenant, sale of goods, and passing off. I’m listed in the Bar Council list of mediators under the most experienced category.
In addition, I sit on many committees concerned with arbitration, mediation and adjudication.
